German ruling spells trouble for Motorola's 3G patent lawsuitsQuick ...

Motorola has likened its enforcement of standards essential patents as a lethal ?bullet? it can use to ?kill? smartphone competitors, but it?s becoming clear that such a strategy won?t be tolerated in the European Union. A German high court preliminarily ruled in Apple?s favor on an appeal to an earlier ban on iPhone and iPad sales in Germany due to alleged infringement of a Motorola patent related to 3G wireless networking standards. According to the court?s ruling, Motorola?s attempts to ban competing products using 3G standards would constitute a violation of antitrust law.

Motorola is among dozens of companies involved in setting the standards for 3G wireless networking used in today?s mobile devices. Working with the European Telecommunications Standards Institute (ETSI), Motorola and others agreed to include certain patented technologies as part of the 3G standards in exchange for an agreement to license those patents to anyone using the standard on fair, reasonable, and non-discriminatory (FRAND) terms. In other words, Motorola and others are compelled to offer a license to any patents deemed essential to the 3G standard for FRAND terms.

Unfortunately, what exactly constitutes FRAND terms was never spelled out by ETSI. Motorola demanded a 2.25 percent royalty on the full retail price of all iPhones and 3G-equipped iPads. Apple rejected the offer as unfair; Motorola then used the 3G standards essential patents as part of its lawsuits against Apple. Naturally Apple told the court that Motorola was seeking an unfair licensing fee, and called its attempts to assert injunctions against Apple a violation of anti-competition statutes.

Apple?s win in Germany

Apple lost one of several German lawsuits brought by Motorola concerning 3G-related patents due to unique constraints on FRAND defenses under German legal precedent. Apple?s original proposed licensing agreement didn?t cover what would happen if Apple tried to have Motorola?s patent ruled invalid. So Apple ended up on the wrong side of those constraints. The decision resulted in a temporary halt on Apple?s online sales in Germany, though Apple was able to secure a temporary reprieve?one day later based on its appeal of the original ruling.

Monday?s ruling by the Karlsruhe Higher Regional Court suspends the injunction until the full appeal process is completed. That may take as long as a year. However, it suggests that a ruling based on summary analysis of the briefs filed by both Apple and Motorola would likely come down in Apple?s favor.

Apple submitted an amended licensing proposal that ?now does contain a clause according to which Motorola can rescind the agreement in the event of a challenge to the validity of the relevant patents.? Since Apple?s proposal now accounts for this scenario, ?the assumption would have to be that Motorola would breach its obligations under antitrust law if it continued to demand that Apple cease and desist from the sale of the iPhone and the iPad,? the court said in a statement.

Un-FRAND-ly strategy is a losing one

Rival Samsung also attempted to leverage its own FRAND-encumbered 3G-related patents against Apple in an effort to take a ?strong stance against Apple during the lingering legal fights.? That strategy backfired in the courts. Judges in the Netherlands, France, Italy, and Germany rejected requests for injunctions based on such patents.

The strategy also put Samsung on the business end of a formal antitrust investigation by the European Commission launched in January. According to the Commission, the investigation will attempt to ?to ?assess whether Samsung Electronics has abusively, and in contravention of a commitment it gave to the ETSI, used certain of its standard essential patent rights to distort competition in European mobile device markets, in breach of EU antitrust rules.?

Motorola could likewise find itself in hot water with the European Commission if it continues to try and assert 3G-related patents against its competitors in violation of its FRAND agreements. Both Microsoft and Apple have complained to the Commission about the company?s tactics, suggesting Motorola is using its standards related patents to stifle competitors.

Furthermore, Apple has filed a lawsuit against Motorola in the US over its use of 3G related patents. In that lawsuit, it claims Motorola?s actions in Germany violated Motorola?s patent licensing agreements with Qualcomm (which makes the 3G chips used in current iPhones and iPads). As a customer of Qualcomm, Apple is protected by the licensing agreement and therefore should not be subject to lawsuits by Motorola.

Apple appealed directly to the ETSI to create a common standard for determining FRAND royalties. ?It is apparent that our industry suffers from a lack of consistence adherence to FRAND principles in the cellular standards arena,? Apple chief IP counsel Bruce Watrous wrote in a letter to he ETSI last November. In addition to setting a standard royalty base and formula for calculating a fair royalty percentage, Apple argued companies should be barred from seeking injunctions based on FRAND-encumbered patents.

Microsoft and Cisco both sent letters to the ETSI agreeing with Apple?s principles. Microsoft even made a public statement?it would not seek injunctions related to any patents made part of any industry standard. Google, for its part, merely committed to maintaining the same legal strategy Motorola has employed with respect to its standards-related patents after it completes its proposed acquisition of Motorola Mobility. With increased scrutiny promised by the Department of Justice and the European Commission on the condition of granting approval of the merger, however, Google may want to rethink that strategy. So far it appears to be a losing one.

But does it even matter? Is it merely the significance and symbolism of the idea itself ? having Office on iPad ? that?s important, or is anyone actually expecting killer software when years of Office on Mac still haven?t provided a truly excellent, fully compatible experience?

Why would Microsoft make Office for iPad?

While education has always been a stronghold of Apple?s, and according to their Q1 2012 conference call, almost the entire Fortune 500 is testing or deploying iPads, for everyone from students to enterprise, having a real, compatible Microsoft Office suite on Windows 8 Tablets could very well sway consumer dollars in Microsoft?s direction.

Why then would Microsoft want to release Office for iPad ? Word, Excel, and PowerPoint ? when making Office an exclusive for their upcoming Windows 8 tablets would boost Microsoft?s own platform and give it a fighting chance against the Apple incumbent?

Because Microsoft is a software licensing company. It?s what they do. Sure, they talk a good platform game, and they?ve succeeded in building platforms, but at their core they?re the guys who licensed DOS and BASIC to the world.

Take Exchange ActiveSync as precedent. Exchange was Microsoft?s attempt to displace BlackBerry from the enterprise. It was the crown jewel of Windows Mobile, the predecessor of Windows Phone. And Microsoft gave it to Apple, Google, and others.

They hurt ? badly hurt ? Windows Mobile to help ? really help ? Exchange ActiveSync. They chose software licensing over platform success. They chose beating BlackBerry over helping Apple and Google.

There are hundreds of millions of iOS devices on the market. The revenue that could be realized by selling Microsoft Office licenses at $30 a pop (assuming a price similar to what Apple charges for the full iWork suite) to those hundreds of millions of iPhone, iPod touch, and iPad users is compelling. Even if Microsoft begins solely with an iPad version of Office ? as Apple did with iWork ? tens of millions of licenses is nothing to sneeze at, not even for Microsoft. It might even make up for a lot of ~$15 Windows 8 Tablet licenses Office on iPad costs them. Software licensing over platform success.

And hey, if Office on iPad helps Microsoft compete against Google Docs, all the better.

Office on iPad could also be similar to Office on Mac ? a second class experience that leads users, and enterprise, dependent on Microsoft?s software to switch over to Microsoft platform to get done what they desperately need to get done.

Of course, Microsoft doesn?t make Halo for the PlayStation 3, so it?s possible Office for tablets will be considered in the same way, but if iPads are really the mainstream consumer computing appliance of the future, Microsoft will want their software, and revenue stream, to be on it.

Office on Mac mattered so much that, upon his return to Apple, Steve Jobs let Bill Gates dwarf him on the keynote stage to announce the deal that would keep Office on the Mac for years to come. It didn?t matter that then, like now, Office on Mac wasn?t great software (consider iTunes on Windows revenge) it only mattered that it was Office and it was on the Mac. It was good enough for most of the people most of the time. It checked a box and removed a barrier to purchase.

The same holds true for Office on iPad. There is a segment of the market, consumer and enterprise, who simply won?t buy or use something that doesn?t run Office. Put Office on it and that box gets checked, that barrier to purchase gets busted down.

Does any of that matter?

If Microsoft can work a Windows 7-class miracle and make a fantastic multitouch version of Office, then absolutely it matters. It?d be a fantastic win for everyone. Microsoft?s reputation for tablet software would grow, which would encourage consumers to give Microsoft?s other offerings, including their platform, a chance. Apple would get more killer software to help them sell more iPads. And customers would get a really great Office suite to work with.

If Office is as middling as it is on Mac, Microsoft?s reputation for poor off-platform software will persist, but Apple will still get a massive name on the App Store, and customers will get an app that may frustrate them but will still be familiar and somewhat comforting.

That?s assuming Microsoft is even making Office for iPad.

The symmetry of an Office for iPad announcement at the iPad 3 event makes for compelling conjecture.

The last time Microsoft appeared on an Apple stage it was to rescue Apple from near bankruptcy and pledge Office to Apple?s user base to mitigate Microsoft?s anti-trust concerns. If Microsoft appears again, it would be to acknowledge Apple?s unprecedented success in consumer electronics and offer Office to Apple?s massive user base.

If it doesn?t happen during the iPad 3 event, it could still happen by way of press release and sudden appearance on the App Store. I don?t have any specific information one way or another, my guess is it will happen.

Microsoft is a software licensing company. Apple is a hardware company. It?s what they do. It?s what they want.

Feels like it?s just a matter of time.

The megaquake that shook the east coast of Japan in March 2011 reactivated dormant faults near Fukushima's beleaguered nuclear reactors, geologists warn.

"A strong quake may occur in the Futaba fault, only 5 to 6 kilometres away," says Dapeng Zhao of Tohoku University. The fault runs parallel to the coast, right past both of Fukushima's nuclear plants.

Zhao's team used data from more than 6000 quakes between June 2002 and October 2011 to make a 3D map of the crust in the area that suffered the largest aftershock recorded on land after the March megaquake: a quake on 11 April in Iwiki. The images show fluid rising through the Pacific plate as it sinks under Japan. They say the March quake transferred stress to surrounding faults, causing them to adjust in aftershocks. The fluid in the Iwiki fault lubricated it, causing it to slip almost immediately in a large, magnitude 7 aftershock (Solid Earth, DOI: 10.5194/se-3-43-2012).

Seismic readings from the Fukushima area reveal stresses and rising fluids similar to those found at Iwiki, so "the possibility of quake generation becomes much larger than before the 11 March quake", says Zhao.

A magnitude 7 quake would release far less energy than the magnitude 9 megaquake, but because the Futaba fault is so close to Fukushima, it would shake both power stations more strongly.

Texas man convicted in bondage, torture case

Jeffrey Allan Maxwell, a Texas man who abducted his former neighbor and tortured the woman while holding her captive for nearly two weeks, was convicted Tuesday.

Maxwell, 59, faces up to life in prison after being found guilty of aggravated kidnapping and two counts of aggravated sexual assault. Jurors, who took less than an hour to convict Maxwell, will hear more evidence during the trial's punishment phase, set to begin Wednesday.

After the judge read the verdict, the victim shared hugs with some people in the courtroom and later smiled. She declined comment.

She testified last week that Maxwell abducted her from her rural home at gunpoint March 1 after beating her in the face and shackling her hands and legs. Then he drove 100 miles away to his Corsicana house, 50 miles south of Dallas. She was rescued 12 days later when authorities went to question him about her disappearance after her house burned down.

12 days of terror
The woman told jurors that he whipped her and sexually assaulted her on a deer-skinning device in his garage and that she endured several more assaults as she was held captive for 12 days. She testified that he kept her chained to a bed and gagged during the first several days, and one day he locked her in a wooden box when he left to run errands.

She said Maxwell -- then the vice president of a Kiwanis chapter -- got sick after she'd been there about eight days, so he stopped raping her and left her unrestrained during the day when they were in the same room.

"What this defendant, Jeff Maxwell, did is monstrous. It is frankly unimaginable and it's inhuman, and it's time to hold him accountable," Parker County prosecutor Jeff Swain told jurors during closing arguments, adding that DNA evidence found on items at Maxwell's house supported the victim's account.

The Associated Press generally does not identify victims of sexual assault.

Defense attorneys, who presented no evidence during the trial, had questioned the woman's credibility, reminding jurors that she said initially that Maxwell was her friend and didn't want him arrested when she ran out of his house March 12, shocking authorities who had gone there to question Maxwell about her disappearance.

Promise to her attacker?
The woman had told jurors that during her initial interview with authorities, she was trying to keep her promise not to implicate Maxwell ? made when she feared for her life ? and that he also had convinced her that someone had hired him to kill her.

Defense attorneys also said authorities took pictures of items in Maxwell's home before obtaining a search warrant, and that an investigator violated the law by telling him that telling his side of the story would help him. They urged jurors to disregard whips, blood-stained sheets and other evidence, as well as his recorded interviews.

"You're probably not going to want to do that, but the law is the law," defense attorney Richard Alley told jurors, later adding that jurors could put whatever "twist" on the case they wanted. "Is this case disturbing? Yes ? on multiple levels, whether it involves criminal activity or not."

During several hours of questioning, Maxwell eventually gives details of the kidnapping and describes the sexual assault on the device, which he says he made for cleaning hogs and deer. He says he chained the woman to the bed every night but also let her read the Bible. He is heard telling the investigator that he never planned to kill her and thought of letting her go after her bruises healed.

"I got myself into something I couldn't figure out how to get out of," he tells the investigator.

He says he had sexual fantasies about bondage but never gives a reason for the abduction and assaults. At one point he blames his "stupidity" and another time tells investigators he doesn't "know all the whys" when asked what could have led him down this path. When later asked if he needs help, he says, "I imagine I do. Yes."

Maxwell and the woman, now 63, were neighbors in a rural Parker County town about 70 miles west of Dallas before he moved seven years ago. The woman testified that she had been friendly toward him but told him to stay away after he started coming on too strong.

ROCHESTER, Minn. -- Medical records are an invaluable tool in treating patients. When a caregiver has ample information regarding a person's medical history, treatments are more effective and efficient. Unfortunately, few people have complete medical records -- due, in large part, to a lack of any universal repository tools for keeping those records. Mayo Clinic, along with its partners in a program called the Southeast Minnesota Beacon Community, is working on solutions to this problem. They are showcasing their work through demonstrations at the 12th annual Healthcare Information and Management Systems Society Conference & Exhibition (HiMSS), from Feb. 20 to 24 in Las Vegas.

In May 2010, southeast Minnesota was one of 17 areas nationwide selected for funding by a U.S. Department of Health and Human Services initiative called the Beacon Community Program. The initiative sought to fund health care entities looking for ways to use technology to improve the efficiency and delivery of health care while cutting costs. The Southeast Minnesota Beacon Community was created through collaboration among Mayo Clinic, Mayo Clinic Health System, Olmsted Medical Center, Winona Health, Allina Hospital Owatonna, and 11 county public health departments in the region. Now, less than two years after receiving funding, the group has been asked to share its work at the HiMSS Conference, using technology and processes it developed to show how health information can be transferred between its member institutions in real time. Two scenarios are being showcased at demonstration kiosks in the HiMSS exhibition hall.

The first scenario demonstrates the generation and exchange of a "Continuity of Care Document," or CCD. In this scenario, a test patient visits Mayo Clinic after being seen at Olmsted Medical Center for diabetes mellitus. Using Health Information Exchange (HIE) technology, Mayo Clinic retrieves a CCD from the patient's visit to Olmsted Medical Center. The document contains information such as immunization records, known allergies and medications being taken, and the results of any tests done during the prior visit.

In the second scenario, a public health nurse is preparing to visit an asthmatic patient in his home, to help solve a problem the patient is having with his medication. The nurse reviews a medication list that is parsed and persisted into the Electronic Public Health Record (EPHR) from other providers' CCDs. The nurse is able to review this list with the patient transfer medications from the list into a current medication reconciliation area and add any additional medications the patient is taking. For the first time the nurse is able to talk with the patient about what medications were prescribed and discuss issues that might prevent the patient from taking the recommended medications.

These scenarios are just a partial demonstration of the full capabilities of Southeast Minnesota Beacon's HIE capacity, which supports the exchange of any consenting patient's information among all providers -- including public health -- in the region. "Improving HIE technology is vital to improving patient care," says Christopher Chute, M.D., Dr.P.H. co-principal investigator for the Southeast Minnesota Beacon Community. "By making patient information available in one place, we will be able to solve problems more effectively, avoid redundancies and improve continuity in care, which will strengthen care delivery and cut costs."

The demonstrations are scheduled for various times Tuesday, Feb. 21, through Thursday, Feb. 23, at kiosks in the conference center, Hall G, booth #11000, in the ONC/FHA Area of Interoperability Showcase. A complete demonstration schedule is available at the ONC booth, #14824, in Hall G.

A few years later, Bledsoe had enough.? ?I went to [former Steinberg partner] David Dunn,? Bledsoe said.? ?I said, ?Hey you can either leave and start your own firm and I?ll go with you or I?m just going to walk and go someplace else because, you know, this guy can?t be my agent anymore.?? At some point, this thing?s going to end badly for Leigh, as what it came to.? And when it went down, when it ended badly, I didn?t want to be on that ship with him.?

The lawsuit filed by Steinberg against Dunn, and the ensuing trial, continued the slow sink.? ?You were depicted as boorish, unstable, abusive, out of touch with your clients, a drunk and, and a womanizer,? Keteyian says, regarding the testimony that came out.? ?I mean, am I missing anything there that they said about you??

?I also killed Christ,? Steinberg says.? He later explains that the jury ?didn?t believe half? of the allegations, which some could interpret as implying that they still believed a pretty large chunk of it.

Steinberg eventually won a big judgment against Dunn, but it was reversed on appeal.? In 2004, Steinberg landed Ben Roethlisberger, and in early 2006 clients Troy Aikman and Warren Moon made it to the Hall of Fame.? (Steinberg introduced Moon at the enshrinement ceremony.)? Still, Steinberg was fired in April 2006 by incoming draft picks Matt Leinart and Winston Justice, and the end of Steinberg?s marriage that same year fueled the decline.

The low point came in 2007.? ?I had started drinking in the day, so I went for a walk,? Steinberg says.? ?The problem is, is that my alcohol level got too high and I was sort of hanging out on a hill, sitting in a vacant lot, you know, just singing away and making noise.? And, I ended up in Hoag Hospital in a diaper, not knowing where I was.?? That?s pretty close to, to bottom as I could ever get.?

Now sober for two years, Steinberg is trying to put his life back together, even after recently filing for bankruptcy.? ?If my story is a cautionary note to anyone out there who?s struggling with any kind of substance abuse, there is help,? Steinberg said.? ?It is possible, but you need to put everything else in your life aside and focus on it.? So, in an unwanted way, I hopefully still can do some good to ease the pain of other people.?

Here?s hoping that Steinberg?s pain has ended, and that he?ll be able to fashion a second act to his career that inspires others who also are trying to turn their lives around.

Shop the block and save on car repairs

If you do your homework in advance of a car problem, you'll end up saving big time on time and money.?

This is one of those tips that you hear and immediately think, ?Easier said than done.?

Why? Most of the time when you need a car repair, you?re pinched. Your car failed at a bad time, you need to get to work or school, and you?re willing to just throw money at the problem so you can get back on the road as fast as possible. You grab a phone book or search Google and just call the first reasonable number that comes up.

There are some times where you just can?t help this. I had a car failure on a long road trip and I was simply at the mercy of Google. I have painful memories of the overpriced towing and overpriced repair in that little town in Wisconsin.

Quite often, though, car repairs spring upon you when you?re near your home, and when that happens, a little bit of legwork in advance can save you a ton of time and cash.

The secret is to shop around in advance of a car problem. That way, when something does go wrong, you have a phone number or two already on your speed dial that you can call with confidence knowing that the prices will be fair and the work will be done well.

So, how do you do that research? Here?s exactly how I whittled things down to my repairman of choice.

First, I sent out a call to my local social network. I asked pretty much everyone that I knew who lived locally if they knew of any good car repair places in the area. People were glad to tell me what they knew. I got a wide variety of answers, but I kept hearing about four names come up time and time again as being places with good prices and really good service.

Next, do your homework on the leading names. Use a mix of the internet and your phone to find out if they work on your type of car(s), if they offer towing services, and what their rates are on some common repairs. I asked about brake replacement and transmission replacement on my model, just to get a feel of what they offered.

If you?re like me, you?ll find that these two steps get your list quickly whittled down to two or so entries. I put them both into my phone.

Now, when I am in a pinch, I can just pull out my phone and call one of those numbers. If they can?t come quickly, I call the other number. I know that in either case, they can handle what ails my car, do it professionally, and not charge me a small mint for the service.

I?ve come to rely on one of these places as my primary stop for significant maintenance (belt replacement, brake pad replacement, and the like) because their prices on these services were stellar and their service great.

Even better, when my friends ask for such a suggestion ? and they have many times in the past few years ? I have a couple great names and numbers that I trust that I can quickly give to them.

Homework pays off. I don?t know how much money and how much worry and even how much time I?ve saved by doing this in advance, but it?s been worth it a hundred times over.

'Late Show': Joan Rivers Jokes About Goldie Hawn's Plastic Surgery And Betty White Sleeping Her Way To The Top (VIDEO)

Age shall not weary or mellow Joan Rivers. She and "Late Show" (Weeknights, 11:35 p.m. EST on CBS) host David Letterman were discussing the weighty topic of ageism in Hollywood when she took the opportunity to spill some juicy gossip about a couple of industry veterans.

Joking about a subject dear to her heart -- plastic surgery, natch -- Joan said Goldie Hawn has had way too much work done. Allegedly. "She's been pulled so tight, they say, that when she swallows she has an orgasm."

Moving on to the topic of sex, Rivers and Letterman agreed that it plays a big part in showbusiness, and Rivers revealed that the casting couch is still an option, even for the more mature ladies.

"Betty White! We know how she came back," joked Rivers. "Suddenly she's back? Come on. Ask backstage! ... She is known in the business as 'Bendover Betty'!"

As he mulled over the gossip, all Letterman could say was "Wow." Who knew Betty White was so versatile?

Santorum distances himself from 'aspirin' comment

(AP) ? Republican presidential contender Rick Santorum is distancing himself from a high-profile supporter's comments about contraception.

The main donor behind Santorum's "super PAC," Foster Friess (freeze), said on MSNBC on Thursday that aspirin used to be an acceptable method for contraception. Friess said that "gals," in his words, "put it between their knees, and it wasn't that costly." He followed the comment with laughter.

Santorum, a devout Catholic, has said he opposes contraception. But he's calling Friess' comment a "stupid joke." And he says he's not responsible for everything his supporters say.

Speaking to reporters after a speech in Michigan, Santorum says the comment by Friess was "in bad taste."

Santorum later told Fox News that he considers Friess "a good man" and "a great philanthropist."
