Judge hopes to decide school finance case while lawmakers in ...

A state district judge Wednesday told lawyers in the Texas school funding case that his intention is to wrap up the lengthy trial in the case by early January so he can render a decision while the 2013 Legislature is still in its regular session. State District Judge John Dietz said in a preliminary hearing that he wants to stay on schedule after the trial begins on Oct. 22 so that state lawmakers can get a reading on the outcome of the case when they discuss funding of public schools during the legislative session.

?I want to try to get it done while things are still active (in the Legislature),? Dietz told attorneys for the state and the various plaintiff groups in the case.?Legislators are expected to study the school finance system during the upcoming session, but no major changes are anticipated until after the Supreme Court has reviewed Dietz?s final ruling, whatever it is. The high court probably won?t hear the case until late 2013.

Hundreds of school districts, including Dallas and several in North Texas, are suing the state over the current finance system, contending that it provides inadequate funding for schools, distributes monies inequitably and violates the current constitutional prohibition against a state property tax.?When the Texas Supreme Court last overturned the school finance system, in 2005, the justices sidestepped the issue of adequate funding but ruled that the property tax rate limit then in effect was tantamount to an illegal state property tax. That decision forced lawmakers to revamp the system a year later.
